HOW TO OBTAIN KANSAS STATE’S SALES AND TAX EXEMPTION:
Generally, nonprofit organizations in Kansas are not exempt from sales taxes. There are exceptions, though.
If your organization qualifies for exemption, create an account on Kansas Department of Revenue website and apply for exemption following this link: http://www.ksrevenue.org/pdf/pub1520.pdf
HOW TO REGISTER WITH KANSAS STATE’S SECRETARY OF STATE:
File the Registration Statement for Solicitation, together with a copy of the Form 990 with an online provider. If the Form 990 is not required for your organization, file a Charitable Financial Statement Form.
Send to: Kansas Secretary of State Memorial Hall, 1st Fl. 120 S.W. 10th Avenue Topeka, KS 66612-1594
Audit: If the organization has received charitable contributions that exceeds $500,000 in the most recently completed fiscal year, it must include an independently audited financial statement of the most recent fiscal year.
Note that the due date is 5 and a half months after the end of fiscal year. If the annual report is not submitted within 90 days following the due date, the organization will be forfeited in Kansas and will need to complete the reinstatement process to return to active standing.
